Rod Stewart and his eldest son, 39-year-old Sean Stewart, were charged with alleged physical battery and being the "primary aggressors" of a physical altercation on New Year's Eve in Palm Beach, Florida. People.com obtained a copy of the probable cause affidavit, which claimed among other things, the father and son have been ordered to appear at the Palm Beach County Criminal Justice Complex on February 5th. The night of the incident, the pair grew "agitated" after their party was denied entree to a private bash held at the exclusive resort, The Breakers. The affidavit states: "The group began to get loud and cause a scene, and refused to follow. . . instructions to leave."

People posted: "The argument escalated and the report alleges Sean 'shoved' what is believed to have been an event security guard, with Rod following with a punch shortly thereafter that struck the guard in the 'left rib cage area.' The report stated that (Rod) then apologized for his actions."

An insider added: "It was a brief misunderstanding and neither Rod nor Sean were detained. . . Apologies were exchanged and there were no injuries."

A second source described the scene: "They were being loud and disruptive all night. It was like a frat party."

Rod a father of eight spoke about how -- barring his two youngest children -- are all products of broken marriages and/or relationships: "If you get to my age and you're not somewhat philosophical, I think there's something wrong with you. All my kids have now sailed through it. They're wonderfully centered, grounded. But, I know the heartache it can bring."

Rod Stewart's next U.S. show is set for February 23rd at Hollywood, Florida's Hard Rock Live.
